IS-II Division
IS-II Division deals with the matters relating to Extradition, Mutual Legal Assistance (MLA), INTERPOL, Drug Law Enforcement & Narcotics Control Bureau (NCB), the National Security Act, 1980, the Central Scheme for Financial Assistance to Civilian Victims /Family of Civilian Victims of Terrorist/Communal/LWE Violence and Cross Border Firing and Mine/IED Blasts on Indian Territory and matters related to Human Rights violations.
At present, the IS-II Division comprises Six Sections/Branch. The brief of mandate allocated to each Section is as given below:
- Legal Cell (LC) – Mutual Legal Assistance in criminal matters & Extradition matters; Letters of request received from and going to MLAT and non-MLAT countries; Service of judicial processes in bailable criminal matters outside India; TADA cases (monitoring); Extradition requests to foreign countries. Complaints against police personnel (except IPS officers and officers of UT Segments).
- National Security Act (NSA) Section – Administration of the NSA, 1980 and representation made therein including court matters on the subject; individual detentions/releases made by the States/UTs and the Central Govt under this Act; Examination of reports received from the State Govts and UTs under Section 3(5) of the National Security Act; Statutory representations addressed to the Central Government in regard to the detentions made under the National Security Act, 1980 by the detenues and his/her family members or by others on his/her behalf and also examining the comments of the State Government on such representations; Writ Petitions arising out of detentions made under the National Security Act, 1980; Filing of Special Leave Petition in the Supreme Court of India challenging the orders of High Courts.
- Victims of Terrorist Violence (VTV) Section – Administration of Central Scheme for Assistance to the Civilian Victims/Family of Victims of Terrorist/Communal/LWE violence, Cross Border Firing, Mine/IED Blast on Indian Territory (CSACV); Receipt of reimbursement proposals from DM/DC through State Government/UT Administration; Examination of the reimbursement proposals in accordance with CSACV Guidelines; Release of reimbursement to DM/DC/State Govt/UT Administration in eligible cases.
- Narcotics Control Bureau – I&II (NCB – I&II) Section – All administrative, establishment and financial matters including budget of Narcotics Control Bureau (NCB); Strengthening of NCB in terms of manpower, buildings, equipment, etc.; All matters relating to release of Central Assistance to States for enforcement of their capabilities to combat illicit trafficking in narcotic drugs and psychotropic substances. Through NCB, coordination of actions by various Ministries/Offices/Departments/States under NDPS Act etc. in connection with enforcement of provisions of the NDPS Act, 1985.
- Human Rights (HR) Branch – Matters relating to commissions on Human Rights and Human Rights Organizations; Appointment of the Members and the Chairperson of the National Human Rights Commission (NHRC); Matters relating to NHRC and allegations of various violations of Human Rights.
- Coordination (CDN) Section – Coordination work in respect of NCB-I&II, VTV, LC, NSA Sections and HR Branch; Manual of Departmental Security Instructions (MoDSI); Matters relating to arrest of Members of Parliament; Matters relating to breach of privilege of Members of Parliament; Matters pertaining to Justice Mukherjee Commission of Inquiry. Residuary matters pertaining to Shah Commission of Inquiry, Maruti Commission of Inquiry, Khosla Commission of Inquiry, Kudal Commission of Inquiry, Thakkar Commission of Inquiry and Jain Commission of Inquiry.
